1. Acceptance of Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Student," "User," or "you") and Emerald Coast Acting Academy ("Academy," "we," "us," or "our"), located at 420 Seascape Lane, Suite 100, Destin, Florida 32541. By accessing or using our website (www.emeraldcoastactingacademy.com), enrolling in any course, or utilizing any service provided by the Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are prohibited from using our website or services.

2. Enrollment and Payment

1. Enrollment: Enrollment in any course at Emerald Coast Acting Academy is subject to availability and our acceptance of your application. We reserve the right to refuse enrollment to any applicant.
2. Payment: Tuition fees are due in full prior to the commencement of the course unless otherwise agreed upon in writing. We accept payments via credit card, debit card, and check. Late payments may be subject to a late fee of $50.
3. Refund Policy: If a student withdraws from a course more than 30 days prior to the start date, a full refund will be issued, less a $100 administrative fee. If a student withdraws between 14 and 30 days prior to the start date, a 50% refund will be issued. No refunds will be issued for withdrawals made less than 14 days before the start date, or after the course has commenced.

3. Student Conduct

Students are expected to conduct themselves in a respectful and professional manner at all times. Disruptive or inappropriate behavior will not be tolerated and may result in expulsion from the Academy without refund. This includes, but is not limited to, harassment, discrimination, and violation of Academy policies.

4. Intellectual Property

All course materials, including but not limited to scripts, handouts, videos, and presentations, are the intellectual property of Emerald Coast Acting Academy and are protected by copyright law. Students are prohibited from reproducing, distributing, or creating derivative works based on these materials without our express written consent.

5. Liability Waiver

By participating in courses at Emerald Coast Acting Academy, you acknowledge that there are inherent risks associated with acting and performance. You agree to waive any and all claims against Emerald Coast Acting Academy, its instructors, staff, and volunteers for any injury, loss, or damage that may occur during your participation, except in cases of gross negligence or willful misconduct.

6. Use of Likeness

Unless otherwise notified in writing, students grant Emerald Coast Acting Academy the right to use their image, voice, and likeness in photographs, videos, and other promotional materials. This includes, but is not limited to, use on our website, social media channels, and marketing campaigns. Students who do not wish to have their likeness used in this manner must notify the Academy in writing prior to the commencement of their course.

7. Changes to Terms and Conditions

Emerald Coast Acting Academy reserves the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting to our website. Your continued use of our website or services after the posting of revised Terms constitutes your acceptance of the changes. 8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Okaloosa County, Florida.

9. Cancellation Policy

Emerald Coast Acting Academy reserves the right to cancel any course due to insufficient enrollment or other unforeseen circumstances. In the event of a cancellation, students will receive a full refund of tuition fees paid.

12. Severability

14. Force Majeure

Emerald Coast Acting Academy shall not be liable for any delay or failure in performance of its obligations under these Terms and Conditions if such delay or failure is due to causes beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

You may not assign your rights or obligations under these Terms and Conditions without the prior written consent of Emerald Coast Acting Academy. We may assign our rights and obligations under these Terms without your consent.
